End User License Agreement Basic License: Standard commercial Desktop usage

We recommend that you print this Desktop Font End User License Agreement for further reference (DOWNLOAD IT FROM HERE).

This license authorizes you to use the selected software font for standard desktop commercial usage only.

Through your downloading and/or installing the licensed font software from Fontscafe.com, you hereby agree to be bound by each and every term of this Desktop Standard commercial print End User License Agreement (“EULA.”) This license allows you to use the downloaded font for standard commercial usage only, that is, any general media BUT NOT web, e-book, mobile applications and film/broadcast usages. For any use other than standard Desktop commercial print usage, please obtain the proper additional license.

1. RIGHTS

You may use the licensed fonts to create images on any surface such as computer screens, paper, web pages, photographs, movie credits, printed material, T-shirts, and other surfaces where the image is a fixed size.

You may use the licensed fonts to create EPS files or other scalable drawings provided that such files are only used by the household or company licensing the font.

You may use the licensed font for personalized Products, Words art includes, but are not limited to, scrapbooking uses involving reproductions of INDIVIDUAL letterforms EXCEPT for the complete set of letters or numbers as digital alphabets (Alphas) for reselling, that is expressly prohibited.

You may use the licensed font in the creation of or as part of a Company Logo.

RIGHTS RESERVED.

This Software is licensed, not sold, to you by Fontscafe, and is licensed for use in accordance with the terms of this Agreement. As a licensee, your ownership of the magnetic and/or optical media on which the Software is recorded, if any, is distinct from and does not grant any right, title or interest in and to the design of the Font or the Font Software itself. All copies of the Software downloaded or installed, including the copy(ies) of any Software that accompanies this document either as part of a downloaded file or on recorded media, such as, but not limited to, magnetic or optical media, remain the exclusive property of Fontscafe. The Fontscafe Font Software and the design of the Font embodied therein are the exclusive property of Fontscafe and are protected under both domestic and international copyright.

You agree to credit Fontscafe as the copyright owner of the Fontscafe Fonts and list the font names, used, whenever and whenever design production or any other credits are shown.

2. REQUIREMENTS/RESTRICTIONS.

Except as may be otherwise expressly permitted by your specific License, you may not distribute, sell, modify, include, adapt, translate, reverse engineer, decompile, disassemble, alter the embedding bits, translate into other font formats or other formats for use with other forms of devices or otherwise copy and/or include the Fontscafe Font Software or the design of the Font embodied therein without the express written consent of Fontscafe. All rights not expressly granted are reserved to Fontscafe.

a. The Font may not be redistributed with the Software's source code.

b. The Font may not be under any circumstances embedded into software or hardware products in which the fonts will be used by the purchasers of such products. Such use requires a different license . Please contact support@fontscafe.com with specific information about your project for a price quote.

c. The Font may not be embedded in Software considered a plug-in, template, skin or theme.

d. The Font may not be embedded in Software that enables an end user to create custom typesetting with the Font.

e. The Font may embedded into any document you send to third parties. Such documents may be viewed and printed (but not edited) by the recipients.

f. Other restrictions may apply. We hereby incorporate all separate restrictions, policies and guidelines as published on our website as if fully set forth herein.

3. NUMBER OF USERS:

The maximum number of simultaneous users is specified in the applicable receipt. All users must belong to the same company or household purchasing the font.

The computers can be connected to any number of output devices, such as laser printers, ink jet printers, an image setter or a film recorder. The font software may be downloaded to the memory (hard disk or RAM) of the output devices that are customarily used by you for the purposes of having such font software remain resident in the output devices.

You further agree to treat the software as confidential information and exercise reasonable care to avoid unauthorised distribution of the Font Software.

G. Service Bureau Restrictions.

To reproduce a particular document at a commercial printer, or service bureau, you can supply non-editable artwork in a PDF format. If the printer or service bureau needs to install the fonts on their computers they will need to purchase a separate Service Bureau licence. Please contact support@fontscafe.com for a price quote.

H. Back Up Copies.

If necessary, you are permitted to make only those reasonable number back-up copies suitable to your usage.

3.THIRD PARTIES AND TRANSFERABILITY.

You may provide the font to a graphic designer, printer or other outputting service that is working on your behalf only if they agree to use the font exclusively for your work, agree to the terms of this license, and retain no copies of the font on completion of the work. You may not distribute the font to third parties or make the font publicly accessible except by embedding or linking in accordance with this EULA.

4. MODIFICATIONS.

You may modify or convert the Font to improve the Font's appearance or performance in the Application Software.

You may not alter Font Software in any manner whatsoever. Reformatting the Font Software into other formats or for use in other operating systems is expressly prohibited. Altering or amending the embedding bits characteristics of the Font Software is expressly prohibited.

You may not modify the licensed font or create derivative works based on the licensed font without prior written consent of Fontscafe.com except to generate files necessary for embedding or linking only as allowed by this license.

Any modifications, derivations and/or adaptations of the Font Software or the design embodied therein, requires the express permission of Fontscafe which expressly reserves a right to create any such modifications, derivations or adaptations.

Derivative works based upon the Fontscafe Font Software may not be sublicensed, sold, leased, rented, lent, or given away without written permission from Fontscafe.

Fontscafe shall not be responsible for unauthorized, modified and/or improperly regenerated, adapted or translated software or derivative works.

5. COPYRIGHT.

You agree that the licensed font is the exclusive property of Fontscafe.com and is protected by Italian, USA and other copyright and intellectual property laws.

Unauthorized copying of the Product even if modified, merged, or included with other software, or of the written materials, is expressly forbidden.

You may be held legally responsible for any infringements on the Fontscafe.com’s rights caused by your failure to abide by the terms of this Agreement.

6. RETURNS and UPGRADES.

The Font software may be returned or exchanged only if defective and if the request is made within 21 days of purchase. Product Upgrades: Upgrades, when made available may be provided at an additional fee.

7. TERMINATION.

You agree that The Agreement shall automatically terminate, without notice from Fontscafe.com, if you fail to comply with any provision contained herein.

8. REVOCATION OF WARRANTIES.

Subject to the representations and warranties stated herein, the Font Software is provided "AS IS" and without fiduciary obligation to you or other warranties of any kind and Fontscafe.com hereby EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS AND IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. FONTSCAFE.COM DOES NOT WARRANT THAT THE OPERATION OF THE FONT SOFTWARE WILL BE UNINTERRUPTED OR ERROR-FREE, OR THAT THE FONT SOFTWARE IS WITHOUT DEFECTS. THE FONT SOFTWARE IS NOT INTENDED AND WAS NOT DESIGNED OR MANUFACTURED FOR USE IN ANY CIRCUMSTANCES WHERE THE FAILURE OF THE FONT SOFTWARE COULD LEAD TO DEATH, PERSONAL INJURY, OR SEVERE PHYSICAL OR ENVIRONMENTAL DAMAGE. THE FONT SOFTWARE IS NOT FAULT TOLERANT AND IS NOT INTENDED FOR USE IN THE CONTROL OR OPERATION OF DEVICES OR EQUIPMENT FOR MANUFACTURING, OR FOR USE IN NAVIGATIONAL DEVICES. UNDER NO CIRCUMSTANCES SHALL FONTSCAFE.COM BE LIABLE TO YOU, OR ANY THIRD PARTY, WHETHER IN CONTRACT OR TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, FOR ANY SPECIAL, CONSEQUENTIAL, OR INCIDENTAL DAMAGES, INCLUDING LOST PROFITS, SAVINGS OR BUSINESS INTERRUPTION AS A RESULT OF THE USE OF THE FONT SOFTWARE EVEN IF NOTIFIED IN ADVANCE OF SUCH POSSIBILITY. Under no circumstances, subject to the conditions noted herein, shall Fontscafe's maximum liability to you or any third party exceed the replacement cost of Font Software or the provision of substitute software, at the sole discretion of Fontscafe.com.

9. COMPLETE AGREEMENT.

You acknowledge that you have read this agreement and understand it and that by using the software you will be bound by its terms and conditions. You further agree that it is the complete and exclusive statement of the agreement between Fontscafe.com and you, which supersedes any proposal or prior agreement, oral or written, and any other communications between Fontscafe.com and you relating to the subject matter of this Agreement. No variation of the terms of this agreement or any different terms will be enforceable against Fontscafe.com unless Fontscafe.com gives its express written consent, including a written express waiver of the terms of this. If any provision of this agreement is held void or unenforceable, that provision will be enforced to the maximum extent possible and the remaining provisions of this agreement will remain in full force and effect. Fontscafe.com expressly reserves the right to amend or modify this License Agreement at any time and without prior notification. Your usage of the font software after modification of this EULA is your express indication to Fontscafe.com that you agree to be bound by each and every term and condition of the modified EULA.
